Cross-Border Investigations Not at Cross Purposes

Thu. December 10, 2015
5:30 pm - 8:30 pm

!

Please join us for a program discussing recent developments and law enforcement trends, risks, and organizational measures regarding cross-border investigations in Europe and the United States
The Volkswagen investigation is a prime example. The company is under enormous pressure, as several law enforcement and regulatory authorities in the United States have opened investigations.

In Germany, however, the investigation is principally being conducted by the Attorney General. While these cross-border investigations were pending, the European Court of Justice struck down the Safe Harbor principles. As a result, it is now extremely difficult to transfer personal data from an internal investigation from the EU to the U.S. consistent with EU law.

Our experienced panelists will highlight the ramifications of the ruling and trans-Atlantic law enforcement trends and also address risks and challenges of cross-border investigations:

• What issues to be on the lookout for
• How to prepare for the risks and challenges, and how to address them
• How to conduct an effective investigation and work collaboratively across borders
• What to do with the investigation findings

The program is perfectly suited for multinational companies located in the United States, as well as law firms, financial advisors, and consulting firms who advise them.

Topics to be addressed will include:

• Enforcement trends in the United States and in Europe
• Enforcement actions and lessons learned (anti-bribery, money laundering etc.)
• Substantive differences between the U.S. & EU (witness interviewing, reporting, privacy, safe harbor)
• Comparison of U.S. and EU restrictions on investigations
• Comparison of treatment of attorney-client privilege
• Leniency program in European antitrust law
• The new decision of the European Court of Justice re: Safe Harbor and its impact on cross-border investigations
• Executing responsive action and investigative plans
