Out-of-Court and Bankruptcy Restructurings: The Face of Distress and Revival in an Easy Credit Market

Thu. December 11, 2014

Join EACCNY partners The Deal and Pepper Hamilton LLP for a webcast on Out-of-Court and Bankruptcy Restructurings.

In today's borrowers' market, what are the key drivers for restructuring that we are seeing both in and out of bankruptcy court and when will default rates start to rise once again? With the 2008 financial crisis behind us and bankruptcy filings down, are distressed investors using different strategies, such as looking abroad or at companies with smaller capital structures?

Join us on December 11th, when with the help of restructuring experts, we will explore what early indicators we should watch out for that will signal a rise in defaults and more restructuring activity to come. We will also talk about where the opportunities are for distressed investors and if companies are really fixing their issues in this easy credit market, or just amending and extending their debt loads? Our panelists will also discuss distressed M&A and what the differences are between getting deals done in court versus out-of-court. Another interesting topic to explore is the rise in activist investing tactics. How does activism - by shareholders and bondholders - affect out-of-court restructuring negotiations? Additionally, we will explore the major differences between an out-of-court restructuring and an in court restructuring and compare the success rates for the two approaches.

We will aim to answer these and other critical questions regarding restructuring and distress with experts in the industry. After just 60 minutes, listeners will have a refreshed perspective on opportunities and strategies for the rest of the year and hopefully some new ideas for 2015.
